ZAGREB, July 12 (Hina) - The lawsuit filed by the Croatian Railways
(HZ) management requesting that the court put a ban on union
protests in which workers are stopping railway traffic is lacking
seriousness and is legally completely unfounded, a vice president
of the Union of Engine Drivers, Ivan Tolic, said following the first
hearing before the Zagreb Municipal Court on Monday.
The HZ management has sued five HZ unions for organising a two-hour
stoppage of railway traffic in the country on April 7, which, the
management believes, represents a violation of the Labour Act. The
management requests that the court put a ban on such actions.
The lawsuit lacks seriousness because the plaintiff has failed to
state the damages and request compensation, therefore the purpose
of the lawsuit is not clear, Tolic said. Apart from this, it is
claimed in the lawsuit that the two-hour work stoppage was actually
a strike, which had not been announced and implemented in a regular
way. If the protest in question was a strike, then it is not the
Municipal Court which is authorised to deal with it, but only the
County or the Supreme Court, said Tolic.
The new hearing has been scheduled for October 11, Tolic said.
He announced that the next move of the Union of Engine Drivers would
be a request on annulling a public bid invitation regarding the sale
of land and business premises, which the HZ management published in
"Vjesnik" daily of July 2. Since HZ workers cannot be given
apartments or housing investment loans, it had been agreed with the
management on a previous occasion that all free land plots along the
railway line be allocated to HZ employees, union members said.
