ZAGREB, Nov 15 (Hina) - The International Criminal Tribunal for
former Yugoslavia (ICTY) on Thursday accepted objections by
defence counsel to an indictment against General Rahim Ademi,
Ademi's attorney Cedo Prodanovic told Hina on the phone on
Thursday.
"The judge has accepted the defence's objection to the indictment
against General Ademi and the indictment has been returned to the
prosecution, which must submit an amended version by November 26,"
Prodanovic said.
The defence objected to the form of the indictment, saying it was
unclear and did not specify documents which should provide evidence
supporting persecution charges. The defence also claimed that
there was no evidence on factual claims from the indictment, i.e.
the indictment did not include any order by General Ademi or
information on the place and time of some crimes he is charged
with.
Judge Almiro Rodriguez partially accepted the defence's request
and gave the prosecution a 14-day deadline to submit a list of all
material evidence on persecution, and the names of 15 victims whose
names were not stated in the original indictment, as well as the
place and date of incidents involving other victims mentioned in
the indictment, and information on other criminal acts cited in the
indictment.
The ICTY prosecution charges General Ademi with crimes against Serb
residents of the Medak Pocket in September 1993, and crimes against
humanity and violations of the law or customs of war. General Ademi
surrendered to the ICTY on July 25 and pleaded not guilty to the
charges.
