ZAGREB, June 6 (Hina) - The Constitutional Court on Wednesday
unanimously overruled as unfounded a request by 35 MPs of the
opposition's Croatian Democratic Union (HDZ) to quash recent
constitutional changes and the decision which proclaimed them.
The strongest opposition party claimed the changes were made
contrary to procedure stipulated by the Constitution, as
parliament's House of Counties had not taken a position before they
were passed.
According to the Constitutional Court, in the time between
receiving the motion to change the Constitution and the moment when
the changes were proclaimed in the House of Representatives, the
House of Counties could have debated them and taken a position. The
changes, along else, abolished the House of Counties. The fact that
the House of Counties failed to take a position does not make the
changes unconstitutional, maintains the Constitutional Court.
The Court also reminds the position of the House of Counties does
not bind the House of Representatives as, under the Constitution,
the House of Counties did not have vetoing right.
