Crnic warns Tomcic that the new or amended election law should
regulate some issues which are currently regulated by binding
instructions of the State Electoral Commission. Those issues refer
to the form and content of election forms, polling stations, the
rights and obligations of foreign monitors and non-government
associations, and the voting of illiterate and handicapped
persons.
He also believes that it is not necessary for judges to be members of
election bodies and that this duty can be entrusted to other
citizens if electoral committees and other electoral
bodies are given adequate technical assistance.
Crnic believes that the participation of judges in the election
process will cause even more court backlogs because judges will not
be able to perform their regular duties.
The new law should also regulate the criteria and funds for the
implementation of elections and fees for the members of electoral
bodies.
Crnic points to the fact that the post of the chairman of the state
electoral commission in other European countries is not held by the
president of the Supreme Court as in Croatia, and that the
commission should be a professional body.
The Supreme Court president also claims that it is necessary for
candidates and voters to identify themselves with their personal
identification number to prevent the abuse of the right to vote.
