Doctors believe that Glavas is still not fit to follow proceedings

ZAGREB, Dec 14 (Hina) - Branimir Glavas is still not fit to follow proceedings in an investigation the Zagreb County Court is conducting against him and Krunoslav Fehir on suspicion of war crimes against Serb civilians in Osijek, according to the latest medical report which arrived at the Zagreb County Court on Thursday.
ZAGREB, Dec 14 (Hina) - Branimir Glavas is still not fit to follow proceedings in an investigation the Zagreb County Court is conducting against him and Krunoslav Fehir on suspicion of war crimes against Serb civilians in Osijek, according to the latest medical report which arrived at the Zagreb County Court on Thursday.

The latest report, addressed to Judge Zdenko Posavec, reads that Glavas is still not fit to follow the proceedings, Glavas's attorney Ante Madunic said.

Judge Posavec released Glavas from custody on the basis of a report compiled by a team of doctors.

The report was based on documents from the Zagreb prison hospital where Glavas had been in custody since December 2 and medical findings from the Osijek Clinical Hospital, where he was transferred after his condition deteriorated due to a 37-day hunger strike.

Next week Judge Posavec will hold a hearing at which the team of doctors will explain their opinion and answer questions from the prosecution and the defence.

Posavec is then expected to decide on the request by a panel of judges of the Zagreb County Court which quashed his ruling on the temporary suspension of the investigation into Glavas and his release from custody and returned the case to Posavec for reconsideration.

The judge's decision on the continuation of the investigation may be appealed and the appeal will be decided again by the panel of judges.

According to unofficial sources, the report by the team of doctors reads that Glavas suffers from anxiety, speaks incoherently and cannot concentrate. He is therefore not able to follow and understand the proceedings or instructions from his attorneys.

Glavas, an independent Member of Parliament, is suspected of ordering the ill-treatment and murder of two Serb civilians and the torture of another three in Osijek in 1991. The investigation into him and Fehir, who is defending himself in freedom, is conducted by the Zagreb County Court.

Glavas is also under investigation in proceedings launched against him by the Osijek County Prosecutor's Office, which charges him with the murder of civilians by the River Drava in Osijek in 1991 and 1992.
