Investigating judge suspends war crimes probe against member of Parliament

ZAGREB, Dec 2 (Hina) - Zagreb County Court Investigating Judge Zdenko Posavec has suspended the war crimes investigation against member of Parliament Branimir Glavas and ordered his release from custody following a deterioration in his health, a member of Glavas's defence team said on Saturday afternoon.

Speaking to reporters after collecting the ruling from Judge Posavec, defence lawyer Ante Madunic said that the court decision was based on the latest opinion of a three-member medical team that had been formed under the judge's orders.

The team of doctors concluded on Saturday that Glavas's health had deteriorated owing to his hunger strike and that he was unfit to follow the court proceedings. This fulfilled the requirement for the application of the provision of the Law on Criminal Procedure under which an investigation may be temporarily suspended on account of the suspect's incapacity.

Zagreb County Court spokesman Kresimir Devcic confirmed in a statement to Hina on Saturday that the investigating judge had made the decision, but would not discuss details of it.

The Zagreb court launched an investigation against Glavas in June this year on suspicion that he had ordered the maltreatment and murder of two Serb civilians in Osijek in 1991 and the torture of another three.

Also under investigation in this case is Krunoslav Fehir, who has been granted provisional release pending completion of the investigation.

Immediately after he was remanded in the Remetinec District Prison in Zagreb in October, Glavas began a hunger strike and after a while was transferred to the prison hospital.
