Prosecution to appeal against suspension of Glavas probe; EC following the case

ZAGREB, Dec 4 (Hina) - Zagreb County Prosecutor Visnja Loncar said on Monday that in the next two days her office would file an appeal against the decision of the Zagreb County Court investigating judge on freeing war crimes suspect Branimir Glavas from custody and on suspending an investigation into his involvement in war crimes in Osijek due to his deteriorated health.
ZAGREB, Dec 4 (Hina) - Zagreb County Prosecutor Visnja Loncar said on Monday that in the next two days her office would file an appeal against the decision of the Zagreb County Court investigating judge on freeing war crimes suspect Branimir Glavas from custody and on suspending an investigation into his involvement in war crimes in Osijek due to his deteriorated health.

"The Zagreb County Prosecution today has received the decision of investigating judge Zdenko Posavec and it will within next 48 hours lodge an appeal against the termination of (Glavas's) detention and temporary suspension of the investigation," Visnja Loncar told Hina.

She declined to explain the grounds of the appeal which will be considered by a panel of judges of the Zagreb County Court. The panel has no deadlines for deciding on the appeal.

The head of the European Commission's Delegation, Viincent Degert, said on Monday that he would request the County Court to deliver Judge Posavec's decision to his office so that EC officials could understand what had actually happened.

We follow every case, particularly this one which is important as it is about war crimes, war crimes' victims and the protection of witnesses, Degert said in Zagreb at a ceremony marking the completion of a project aimed at strengthening the capacity of the Croatian Office for the Suppression of Corruption and Organised Crime (USKOK).

The EC representative went on to say that the Glavas case had initiated debates on immunity of members of parliament as well as on possibilities for pre-trial detainees to exert pressure on the judicial system if they decide to go on hunger strike.

On Saturday, Judge Posavec suspended the war crimes probe against independent member of parliament Glavas in the so-called Garage Case on account of his deteriorated health and ordered his release from custody.

In the Garage Case, Glavas is suspected of ordering the torture and murder of two Serb civilians from Osijek and the torture of another three in 1991.

He is also one of the suspects in the so-called Sellotape Case, referring to the murder of Serb civilians by the Drava river in Osijek in the winter of 1991/92. The investigation into this case was formally launched on October 30 following an order by Osijek County Court investigating judge Mario Kovac.

After 37 days of a hunger strike, Glavas was released from a prison hospital in Zagreb on Saturday and transferred in a serious condition to the intensive care unit of the Osijek Clinical Hospital where he was subjected to further medical examinations.
