THE HAGUE, 22 Oct (Hina) - The Appeals Chamber of the International
Criminal Tribunal for Former Yugoslavia (ICTY) will hand down on
Wednesday 29 October 1997 its judgment on the appeal filed by
Croatia against ICTY's subpoena duces tecum, a Tribunal's
statement said Wednesday.
This means that the ICTY has postponed the adoption of the decision,
since it should have been released last week.
The ICTY statement recalled that Croatia had objected to the
decision of the Trial Chamber which establishes 'the authority and
power of the Tribunal to issue compulsory orders to States and
individuals, including high government officials, for the
production of documents required for the preparation or conduct of
a trial'.
Following Croatia's appeal, a hearing was held on 22 September 1997
in the Appeals Chamber, which was presided over by Judge Antonio
Cassese. After representatives of the Republic of Croatia and ICTY
prosecutors presented their arguments and after legal experts
presented their opinions, it was decided that the ICTY decision
would be made known in about three weeks.
