THE HAGUE, Mar 17 (Hina) - The Judge of the Hague-based
International Criminal Tribunal for the Former Yugoslavia (ICTY),
Gabrielle McDonald, directed that the hearing on the issuance of
Subpoena Duces Tecum in the Blaskic Case, scheduled for 16 April
1997, should be held before a panel of judges, and not a single
judge, "considering the significance of the issues to be
addressed", ICTY said in a statement on Monday.
The three-member Trial Chamber II would be composed of Judges
McDonald, Odio-Benito and Jan, the statement said.
In her order dated 14 March, Judge McDonald requested that
the amicus curiae briefs on the following questions be delivered by
7 April 1997:
- the power of a Judge or Trial Chamber of the ICTY to issue a
Subpoena Duces Tecum to a sovereign state;
- the power of a Judge or Trial Chamber to make a request or
issue a Subpoena Duces Tecum to a high government official of a
state;
- the appropriate remedies to be taken if there is non-
compliance with a Subpoena Duces Tecum or a request of a Judge or
Trial Chamber.
