THE HAGUE, Feb 28 (Hina) - The Counsel for Defendant General
Tihomir Blaskic on Friday requested of the International
Criminal Tribunal for the Former Yugoslavia (ICTY) the
issuance of a subpoena to "the Republic of Bosnia and
Herzegovina (BiH) to deliver certain documents which are
believed to exculpate" their defendant, and which "are not
otherwise available" to the Defense, the ICTY said in a
statement.
"These documents are believed to be material, relevant
and exculpatory to the accused, and therefore crucial for the
Defense's adequate preparation for trial", said the letter
forwarded to the Tribunal by Blaskic's attorneys Anto Nobilo
and Russel Hayman.
The Defense requested, among else, the following:
documents relating to cease-fire arrangements and request made
by HVO representatives for investigations into alleged
wrongful acts committed in the course of the conflict;
evidence of the activities and whereabouts of the Army of BiH
in the Lasva Valley between May 1992 and April 1994; documents
relating to a cease-fire agreed to by the Accused on 16 April
1993 and any subsequent violation of it by the Army of BiH.
The Defense requested of the Tribunal a hearing on this
Motion on 12 March.
