ZAGREB, Nov 25 (Hina) - The Croatian Government on Thursday decided to forward a proposal to the Constitutional Court for the establishment of the temporary disability of the President of the Republic Franjo Tudjman to perform his
constitutional duties. The temporary disability of President Tudjman to perform his constitutional duties means that he remains the President of the Republic and that Parliament President Vlatko Pavletic is replacing him during his temporary disability, Premier Zlatko Matesa told reporters this evening, following a government session which was held behind closed doors. According to the Constitutional Law on Temporary Disability, the Constitutional Court should decide about the Government's proposal within 24 hours. ZAGREB, Nov 25 (Hina) - The Croatian Government on Thursday decided
to forward a proposal to the Constitutional Court for the
establishment of the temporary disability of the President of the
Republic Franjo Tudjman to perform his constitutional duties.
The temporary disability of President Tudjman to perform his
constitutional duties means that he remains the President of the
Republic and that Parliament President Vlatko Pavletic is
replacing him during his temporary disability, Premier Zlatko
Matesa told reporters this evening, following a government session
which was held behind closed doors.
According to the Constitutional Law on Temporary Disability, the
Constitutional Court should decide about the Government's proposal
within 24 hours.
The premier said that prior to today's session, he had sent a
request for the President's doctors' team to state its opinion on
the existence of circumstances indicating temporary disability.
"The doctors' team was unanimous that there are reasons leading to
the conclusion that there is a basis for introducing the temporary
disability of the President of the Republic", Matesa said. The
Government's request to the Constitutional Court was based on this
opinion.
Prior to the government session, Matesa held talks with the
President's doctors' team at Zagreb's 'Dubrava' hospital. The
meeting with the doctors marks the beginning of the procedure in
line with the Constitutional Law on Temporary Disability, Matesa
said after the talks with the doctors' team.
The institute of temporary disability is a new institute in
Croatia's legislation, established yesterday with the
Constitutional Law, and this is the first time it is being applied.
According to the Constitutional Law, the temporary disability of
the President of the Republic, which the Constitutional Court
decides about, lasts 60 days. Upon the expiry of the deadline, and
if reasons for the temporary disability of the President of the
Republic have not ceased to exist, the Government suggests to the
Constitutional Court to re-establish temporary disability.
