ZAGREB, May 3 (Hina) - Croatia's Supreme Court turned down an appeal
of Attorney Cedo Prodanovic which he filed against a ruling of
Zagreb County Court that six former inmates in the Jasenovac
concentration camp, who were not named in the indictment, could not
receive the status of injured parties in the trial of Dinko Sakic,
an ex-commander of that World War Two concentration camp.
On Monday before the hearing of witnesses resumed, Drazen Tripalo,
the president of the panel of judges which is conducting the Sakic
trial, informed about the ruling of the Supreme Court.
In the Sakic case, Attorney Prodanovic is presenting the family of
Doctor Mile Boskovic, who was killed in the camp. During the trial
Prodanovic has requested to present another six former prisoners
who asked him to be their attorney in the trial. These six people are
Lea Prasek, Ildika Ivanji Petrovic, Nenad Poznanovic, Noemi
Massaroli, Mihajlo Maric and Josip Erlich.
In its decision the Supreme Court cited the law on criminal
procedure saying that the injured party is a person whose any
personal or ownership rights are threatened or violated by a
criminal act and that the violation of such rights must be describe
by facts in an indictment.
The indictment issued by the County State Attorney's Office
mentioned names of fourteen (14) injured parties, including Mile
Boskovic. Names of none of six aforementioned people who gave power
of attorney to Prodanovic, have been cited in the indictment. They
can receive the status of the injured parties in case that the
indictment is changed.
