ZAGREB, Nov 29 (Hina) - Croatia informed the ICTY secretariat, in accordance to Article 59 of rules on procedure and evidence of the Hague-based tribunal, that retired general Janko Bobetko, was not fit for any trial because of his
health condition, Croatian Ambassador to the Netherlands, Jaksa Muljaccic, said on Friday.

fit for any trial because of his health condition, Croatian

The official information on results of the examination of Bobetko's
condition, which a doctors' team carried out, was forwarded to the
Secretariat of the International Criminal Tribunal for the former
Yugoslavia on Thursday afternoon though diplomatic channels.
On Thursday the Croatian government received th findings of the
doctors' team which the Zagreb County Court sent via the Justice
Ministry.
According to a statement of an investigating judge, the 83-year-old
general was unfit to take part in any court trial due to his
deteriorated health condition.
Under Regulation 59 of the Rules on Procedure and Evidence of the
ICTY, the government should notify the ICTY Secretariat of the
reasons for non-compliance with the ICTY's order on the handing of
the indictment and arrest. The ICTY can then send its own medical
team to establish if the indictee's condition prevents the
implementation of its order.
Bobetko was placed in the coronary unit of Zagreb's Dubrava
Clinic's Institute for Heart Diseases on November 14 and the team of
experts to assess his condition was set up on November 19 at the
request of Zagreb County Court investigating judge Zoran Luburic.
