The chairman of the parliamentary Committee on the Constitution,
Rule Book, and the Political System, Mato Arlovic, told Hina on
Wednesday afternoon that the resignation of the Prime Minister was
regulated by Article 115 of the Constitution.
Under said article, if the parliament fails to give a vote of
confidence in the premier designate and his candidates for
government posts within a period of 30 days, the Parliament
President will notify the President of the Republic about this and
the President of the Republic will immediately make a decision on
the dissolution of the parliament and call a parliamentary
election.
The deadline within which the parliament should vote about
confidence in Racan's government starts tomorrow and expires on
August 9, said Arlovic.
Some legal experts, for example Zagreb Law School professor Branko
Smerdel, believe the deadline should start today and expire on
August 8.
Following today's talks with President Stjepan Mesic, Racan said he
would try to form the new government "as soon as possible" and begin
talks with coalition partners immediately.
Regulations of Articles 109, 110, and 111 of the Constitution,
which envisage a repeated appointment of the premier designate,
including the appointment of a temporary, non-party government,
together with the announcement of new elections, refer to a
situation when the government is formed immediately after
parliamentary elections.
