NEW YORK, May 17 (Hina) - The UN Security Council on Friday amended the Statute and regulations of the International War Crime Tribunal for the former Yugoslavia (ITCY) and the International War Crime Tribunal for Rwanda (ICTR), by
which issues of judges' citizenship is regulated more thoroughly.
NEW YORK, May 17 (Hina) - The UN Security Council on Friday amended
the Statute and regulations of the International War Crime Tribunal
for the former Yugoslavia (ITCY) and the International War Crime
Tribunal for Rwanda (ICTR), by which issues of judges' citizenship
is regulated more thoroughly. #L#
The Council unanimously adopted a resolution defining judges'
citizenship as that which they themselves use in realising their
civil and political rights.
Original regulations of both tribunals excluded the possibility of
judges of the same citizenship be in the same trial chamber, wishing
to guarantee representation for as many countries as possible.
With an increase of trials before the ICTY and ICTR came an increase
in the number of judges, which posed a problem, since a judge with
dual citizenship, one of which was the same to another judge, was
appointed to a ICTR trial chamber.
The Security Council decided that with multiple citizenship, the
original regulation should be dropped, although it is still in
effect for judges with only one citizenship.
