OSIJEK, May 9 (Hina) - Twenty-six former Osijek-Baranja County assembly councillors, who tendered their resignations in early April, on Friday filed a lawsuit with the Administrative Court seeking the voiding of decisions the county
assembly adopted on April 17, representatives of the HDZ, HSP, and HSLS said.
OSIJEK, May 9 (Hina) - Twenty-six former Osijek-Baranja County
assembly councillors, who tendered their resignations in early
April, on Friday filed a lawsuit with the Administrative Court
seeking the voiding of decisions the county assembly adopted on
April 17, representatives of the HDZ, HSP, and HSLS said. #L#
Representatives of said three opposition parties' county branches
told a news conference the April 17 decisions were adopted
unlawfully because the assembly, following the resignations of 26
councillors, did not have a quorum at the session in question.
They also claimed the Osijek-Baranja County assembly did not exist
after their resignations.
On April 23, the local HDZ (Croatian Democratic Union), HSLS
(Social Liberals), and HSP (Croatian Party of Rights) filed a
complaint with the Constitutional Court "over the unlawful work of
the Osijek-Baranja County Assembly on April 17 and the decisions
unlawfully adopted then".
When the three parties' councillors resigned to their posts, the
Croatian Peasant Party replaced its former councillor Stjepan Rob,
who had joined the HDZ and tendered his resignation.
The coalition governing this eastern county says the law enables
maintaining a quorum even if the majority of councillors have
resigned "as long as there is will among those who made up the quorum
to appoint the replacements of those who have resigned".
The justice ministry has verified this interpretation, stating
such replacements counted in the quorum necessary for the session
to proceed.
