Prosecution charges ex-Bosnian Army top commander with crimes against Croats in Herzegovina

Delichas so far been indicted for war crimes which a Mujaheedin unit,incorporated in the Bosnian Army, committed against Croats and Serbsin central Bosnia, while the draft amended indictment charges him withcrimes which the Army of Bosnia-Herzegovina committed against Croatsin Herzegovina and the town of Bugojno in 1993.
THE HAGUE/ZAGREB, Nov 12 (Hina) - Prosecutors of the International Criminal Tribunal for the former Yugoslavia (ICTY) have motioned changes to the indictment issued against Rasim Delic, a former commander of the Main Staff of the Army of Bosnia-Herzegovina. Delic has so far been indicted for war crimes which a Mujaheedin unit, incorporated in the Bosnian Army, committed against Croats and Serbs in central Bosnia, while the draft amended indictment charges him with crimes which the Army of Bosnia-Herzegovina committed against Croats in Herzegovina and the town of Bugojno in 1993.

The existing indictment alleges that Delic is responsible for the murder of 24 Croatian villagers and captured HVO (Bosnian Croat) soldiers in the village of Maline/Bikosi near the central Bosnian town of Travnik on 8 June 1993. He is also charged with the murder of 14 Serb inmates and the rape of three women imprisoned in the Kamenica camp near the town of Zavidovici in summer 1995. The crimes were committed by the 'El Mujahid' unit which was a part of the Bosnian Army's Third Corps.

The draft of an amended indictment alleges that Delic is responsible for crimes which Bosnian Army troops committed against villagers in Doljani near the town of Jablanica. During that assault, nine civilians were killed with some of them being murdered in a very cruel way.

He is held responsible for the killing of 56 civilians, who died during the Bosnian Army's attacks on the villages of Grabovica near Jablanica and Uzdol near the town of Prozor in September 1993.

Delic's deputy Sefer Halilovic has stood trial for the Grabovica and Uzdol massacres, and verdict for that trial is soon to be announced.

The draft of the amended indictment also charges Delic with the 'disappearance' of 21 HVO soldiers who were captured by the Bosnian Army when it took over the town of Bugojno on 24 July 1993.

In that operation, 22 HVO soldiers were captured. One of them managed to escape. Remains of one of the soldiers from that group were unearthed. Others are believed to have been killed.

Delic is held liable according to his commanding responsibility. While holding a position of superior authority, he failed to conduct investigations and punish perpetrators of those crimes, read the draft of the amended indictment, signed by ICTY Chief Prosecutor Carla del Ponte on 31 October.

The draft amendment will take an effect only if the relevant trial chamber of the ICTY confirms the document.
