Supreme Court extends jail term for Paulin Dvor convict, quashes acquittal of other indictee

OSIJEK, June 3 (Hina) - The Croatian Supreme Court has decided toextend the prison sentence to Nikola Ivankovic, who was sentenced bythe Osijek County Court to 12 years in prison for war crimes in PaulinDvor, to 15 years in prison.
OSIJEK, June 3 (Hina) - The Croatian Supreme Court has decided to extend the prison sentence to Nikola Ivankovic, who was sentenced by the Osijek County Court to 12 years in prison for war crimes in Paulin Dvor, to 15 years in prison.

The Supreme Court also quashed the acquittal of the other indictee in this trial, Enes Viteskic, and decided that he be retried before the County Court in that eastern city, a person close to one of the parties in the trial said on Friday speaking on condition of anonymity.

The Supreme Court confirmed to Hina that its ruling was sent to the Osijek County Court on 31 May.

No information could be obtained from the Osijek Court on Friday pertaining this case.

A lawyer for Viteskic, Davor Krtic, told Hina today he could not comment on the Supreme Court's ruling as he had not yet received it. He added that he expected to get it on Monday.

A lawyer for Ivankovic, Domagoj Resetar, said he was surprised by the Supreme Court decision which he was still not acquainted with. He added that he would be able to say something more after he received the decision in writing.

In April 2004, the County Court in Osijek sentenced Ivankovic to 12 years in prison and acquitted Viteskic. The two men, former members of the Croatian Army reserve units, were indicted for war crimes which they committed together with a group of unknown men on 11 December 1991 in the village of Paulin Dvor outside Osijek. Ivankovic and Viteskic were accused of killing 19 Serb villagers out of revenge, while they were off duty.
