69 disputes solved by mediation programmes at Commercial Court

ZAGREB, Feb 13 (Hina) - Since a pilot project for the alternative settlement of disputes was launched at the Zagreb Commercial Court in April 2006, 69 disputes have been successfully solved by the court-annexed mediation programmes.
ZAGREB, Feb 13 (Hina) - Since a pilot project for the alternative settlement of disputes was launched at the Zagreb Commercial Court in April 2006, 69 disputes have been successfully solved by the court-annexed mediation programmes.

Since then, 320 cases have been sent to the court to be settled with the use of mediation.

A judge and mediator at the court, Ivana Mlinaric, told the press at the start of a two-day international conference on mediation discussions that apart from the 69 cases that had been settled by mediation, 14 complaints had been withdrawn as a result of successful mediation proceedings.

The Commercial Court annually receives some 6,000 cases.

Judge Mlinaric added that mediation proceedings would produce better results after lawyers and interested parties were informed to a greater extent about the advantages of the court-annexed mediation programmes.

"This is cheaper for interested parties as they can continue operating and do not need to engage higher-instance courts," she explained.

Labour disputes, disputes regarding indemnification and compensation and copyrights' violations can easily be settled through alternative models of settling disputes.

Judge and mediator Neda Nekic thanked the British Embassy in Zagreb and the British government fund Global Opportunities for funding the promotion of mediation within the Commercial Court's pilot project.

William Marsh, the director of the Conflict Management International (CMI) that has been offering expert assistance in the project, said that family disputes had been solved through mediation in Great Britain for several decades.

The two-day conference pooled justice ministry officials from 17 countries and the European Union.

The purpose of the conference, that was opened by British Ambassador John Ramsden and Croatian Justice Ministry State Secretary Snjezana Bagic, is to exchange ideas and experience in mediation in individual countries.
