Draft amended indictment legally, politically unacceptable - justice ministry

ZAGREB, May 10 (Hina) - The Justice Ministry on Tuesday issued a pressrelease voicing disagreement with the allegations in the Hague warcrimes tribunal's draft amended indictment against generals IvanCermak and Mladen Markac, which charge state, military and localleaders in office in 1995 with participation in a joint criminalenterprise aimed at expelling Serbs from Croatia.
ZAGREB, May 10 (Hina) - The Justice Ministry on Tuesday issued a press release voicing disagreement with the allegations in the Hague war crimes tribunal's draft amended indictment against generals Ivan Cermak and Mladen Markac, which charge state, military and local leaders in office in 1995 with participation in a joint criminal enterprise aimed at expelling Serbs from Croatia.

The ministry said such allegations were legally and politically unacceptable for Croatia, and announced engagement in the case through the so-called friends of the court so that the UN court would refuse to confirm the amended indictment.

The ministry said that although it disagreed with the allegations, it underlined the government's readiness to cooperate fully with the tribunal.

According to the press release, the allegations mentioned above were legally unacceptable because the term "joint criminal enterprise" in an indictment against two individuals could not cover tens of thousands of "known and unknown persons".

The ministry said such allegations were also contrary to the foundations of the Hague tribunal because it had been founded to try individuals for grave crimes against international humanitarian law. It added that such allegations could not be covered by the term "collective responsibility".

The ministry said the allegations were politically unacceptable because they questioned the legitimacy of an armed operation which had been aimed at liberating occupied parts of Croatia.

According to the press release, the ministry is considering the possibility of Croatia's legal intervention in the case in accordance with Article 47 of the tribunal's Rules of Procedure and Evidence.

Under said article, the Trial Chamber may invite or approve the request by a state, organisation or person to approach the chamber and state its positions on any issue chosen by the chamber if the chamber considers this desirable for a correct judgment in a case.

Croatia has a legitimate interest to point to the Trial Chamber, through the friends of the court, the unacceptability of the allegations and propose that the tribunal refuse to confirm the amended indictment.
