SARAJEVO, Mar 9 (Hina) - A law which would make war-time decisions
on abandoned houses in the Croat-Muslim Federation of Bosnia-
Herzegovina no longer valid failed to be passed Monday once again.
Abandoned houses are one of the biggest obstacles to a speedier
return of refugees.
Today both houses of the federal parliament met in order to finally
adjust views on the matter at the request of deputy international
High Representative for the implementation of the Dayton peace
agreement Hans Schumacher.
The law, proposed by the federal government, envisages that all
pre-war tenancy rights holders, who abandoned their homes during
the war, be guaranteed the possibility to return to them. All
persons who subsequently moved into these houses should be provided
with alternative accommodation by competent cantonal authorities
and financial support of the international community.
Party of Democratic Action representative Semiha Borovac proposed
an amendment under which war-time decisions on the allocation of
abandoned flats would not be automatically proclaimed invalid but
"could be rescinded at the party's request". Borovac's proposal was
supported at the House of Representatives by a majority vote of her
party.
According to Mate Franjicevic of the Croatian Democratic Union of
BH bench, that amendment would radically change the concept of the
whole law and open the "possibility for endless court proceedings
which would postpone the refugees' return till the 21st century".
The federal parliament's House of Peoples adopted the law in its
initial form, as put forward by the federal government, without the
amendment.
According to provisions of the federal Constitution, both houses of
the parliament now have the obligation to adjust differences. Until
then the law cannot come into effect.
According to the Sarajevo Declaration on the return of refugees,
adopted earlier in February, the law on abandoned flats was to
become invalid by the beginning of this month.
