STATE JUDICIAL COUNCIL ADOPTS RULE BOOK

ZAGREB, Sept 27 (Hina) - After a four-hour debate on Thursday, the new composition of the State Judicial Council (DSV) adopted at its second session a new Rule Book with a majority vote. Eight members voted for and three against the Rule Book. The most disputable issue for the 11-member DSV was the appointment of judges in case when a large number of candidates apply for few judges' positions, as has been the case with 41 candidates who applied for the positions of six Supreme Court judges. Under the law, the candidate with the majority of DSV votes (eight) is appointed a judge. In case more candidates are chosen with the same number of votes, the final decision is made in another vote. If all free judges positions are not filled in the first round, another debate is held about all candidates who have not passed the first voting round. The DSV decided to forward to the parliament a request that Radovan Ortynski be stripped of immunity due to a private lawsuit filed against him while he was an investigating judge. The parliament is in charge of stripping the State Prosecutor, the post Ortynski now holds, of immunity. The DSV stripped three judges of immunity due to criminal acts which are not covered by judges' immunity. The judges enjoy immunity only for opinions and decision-making in court proceedings.
