ZAGREB, Nov 29 (Hina) - The ICTY Appeals Chamber rejected two Croatian applications in which Zagreb challenged an indictment and a warrant for the arrest of General Janko Bobetko. The Appeals Chamber assessed that the rules of the
tribunal for procedure and evidence provided Croatia with no ground for appealing against the arrest warrant.
ZAGREB, Nov 29 (Hina) - The ICTY Appeals Chamber rejected two
Croatian applications in which Zagreb challenged an indictment and
a warrant for the arrest of General Janko Bobetko. The Appeals
Chamber assessed that the rules of the tribunal for procedure and
evidence provided Croatia with no ground for appealing against the
arrest warrant. #L#
According to the explanation the chamber gave for its decision, a
country cannot cite legitimate political interests as its reasons
for submitting a deposition to the court because of some
interlocutory decision, and only the violation of the right can be
the reason for the party to seek a review.
The decision also read that the Hague-based tribunal would not
address the applications submitted by an indictee or defence
lawyers before the indictee in question appeared before the
tribunal.
The country, which is told to execute the arrest warrant, has no
grounds to question such warrant, the decision said.
The Appeals Chamber added that the prosecution did not need ask for
an interview with a suspect, whom it was planning to indict, and the
prosecution was also not obliged to submit evidence which showed
that the apprehension was necessary.
The chamber said that the regular procedure for the arrest and
detention was in force.
Concerning the provisional release, the Appeals Chamber said it
could address the issue only after a trial chamber considered it.
