Under the court's decision, Croatian Army officer Andrija
Bartulic, who challenged the constitutionality of the minister's
decision, can demand from the ministry to return him to work.
Bartulic had been dismissed after disciplinary proceedings under
Rados's decision.
The majority of Constitutional Court judges supported judge-
rapporteur Emilija Rajic's proposal that the minister's decision
be quashed because it violated freedom of speech.
The decision is unconstitutional because it was adopted and applied
in an invalid way and there were no legal grounds for its adoption,
the court decided.
