ZAGREB, April 4 (Hina) - The Zagreb County Court has notified the justice ministry that it is not able to serve an indictment, issued by the Hague-based UN war crimes tribunal, on retired General Janko Bobetko because of his
deteriorated health condition.

Pursuant to the constitutional law on cooperation between Zagreb
and the International Criminal Tribunal for the former Yugoslavia
(ICTY), an investigating judge of the Zagreb County Court informed
the justice ministry that the indictment could not be served on
Bobetko because of his poor and deteriorated health condition, the
local court said in a statement on Friday morning.
The court added that there were no legal conditions to serve
Bobetko's lawyers with the indictment in case when the indictee was
incapable of receiving it.
The county court will continue following the condition of the
retired general in order to establish if he would be able to take
part in a court process, according to an order of the ICTY of 19
March 2003, read the statement signed by the county court's
president, Bozidar Rumenjak.
The deadline, set by the ICTY, for serving the indictment on Gen.
Bobetko expires on 4 April (today).
ICTY asked the Croatian government to serve the indictment on that
high-ranking officer or on his attorneys, saying that upon the
service, it would immediately suspend a warrant for his arrest.
A team of doctors treating Bobetko, reported on March 28 that the
patient was still in the intensive care ward of the cardiological
department and that for the last month had been bad-ridden.
