ZAGREB, Jan 28 (Hina) - Justice Minister Ingrid Anticevic Marinovic
on Tuesday refuted allegations of a lawyer, Ante Nobilo, who
accused the incumbent government of implementing the idea of the
late President Franjo Tudjman on the prevention of the return of
Serbs, while enforcing law on compensation for damage. #L#
"This is a groundless accusation, given that mined houses will be
reconstructed but according to the Reconstruction Law," the
minister said at a news conference.
Responding to Nobilo's claims, she said that all the three laws
pertaining the state responsibility for damage caused by members of
the Croatian armed and police forces during the Homeland War,
damage caused due to terrorist acts and public protest rallies and
damage caused in the former Yugoslav federation (SFRY), were based
on the prinicples of justice and fairness and the equal burden of
public committments and that they did not disciriminate any
citizen.
She added that the three laws should be linked with the law on
reconstruction which covered the renovation of houses owned by
Croatian citizens and damaged in blasts of explosive devices.
Suits which were filed by citizens who sought damages and which were
terminated during 1996 and 1999 by the revokation of Articles 180
and 184 of the law on obligations and liabilites will be resumed
under provisions of the three new laws, and the houses in question
will be reconstructed according to the law on reconstruction, the
minsiter said.
Lawyer Nobilo has been quoted by some media as saying that instead
of trying to compensate for at least some part of the damage
inflicted to the citizens of Serb origin, the government is
proposing a new law on the liability for damage caused during
terrorist operations and public rallies which will, according to
him, make it impossible for Serbs and some "unwelcome Croats" to
receive damages for the destroyed assets.
