ZAGREB, Jan 27 (Hina) - Croatia's power supply company HEP on Monday
forwarded a request to the Slovene government for resolving a
dispute over a jointly owned nuclear power plant peacefully -- a
draft pre-arbitration settlement on the ownership, status and
financial dispute over Krsko, HEP said in a statement. #L#
HEP states that its request is based on the fact that the Slovene
government, with a decree dated July 30, 1998, transformed the
Krsko plant into a public company exclusively owned by Slovenia,
thus seizing HEP's assets in the plant, which is located in
Slovenia.
HEP claims US$717.5 million in damages -- the value of half of Krsko
in 1998. According to HEP, there is additional interest up to the
date of the damages payoff.
The Croatian government approved HEP's request last week.
After long-term negotiations, the two neighbouring states on July
5, 2001 initialled and on December 19, 2001 signed a deal on Krsko
which both parliaments should have ratified by July 2002.
HEP's request to the Slovene government, as that of a foreign
investor, for settling the dispute peacefully, with a three-month
deadline to decide, is a precondition for launching arbitration
proceedings as stipulated by the Energy Charter, the Croatian
company said in the statement.
