ZAGREB, Nov 9 (Hina) - The Croatian Supreme Court has upheld appeals by former Zagreb County State Prosecutor Krunoslav Canjuga and lawyer Mirko Batarelo, and at the same time rejected the request by the Office for the Prevention of Corruption and Organised Crime (USKOK) for an investigation into the two men on suspicion that they committed bribery.

The Supreme Court decided on 28 October to uphold the appeals of Canjuga and Batarelo against a ruling of the Zagreb County Court on launching a probe into Canjuga, suspected of having taking bribes, and Batarelo, suspected of offering bribes to the then Zagreb County State Prosecutor.

The Supreme Court holds that there are no grounds for suspicion that the two might have committed that sort of white-collar crime.

The Supreme Court also holds that the two appellants are right when they say that surveillance conducted against them by the police and USKOK was carried out unlawfully.

The Supreme Court explains that transcripts of conversations between Canjuga and Baterelo were unlawfully obtained by the prosecutors and without a relevant warrant issued by the investigating judge.
