DETENTION REQUESTED FOR EIGHT EX-MILITARY POLICE ACCUSED OF WAR CRIMES

SPLIT, Aug 26 (Hina) - Following the Supreme Court's quashing of theacquittals of eight former military police accused of war crimes inSplit's Lora prison in the early 1990s and a request for a retrial,the county state prosecutor in the southern coastal city has requestedsetting detention for the eight men, the Split County Court said onThursday.
SPLIT, Aug 26 (Hina) - Following the Supreme Court's quashing of the acquittals of eight former military police accused of war crimes in Split's Lora prison in the early 1990s and a request for a retrial, the county state prosecutor in the southern coastal city has requested setting detention for the eight men, the Split County Court said on Thursday.

The decision on setting detention will most probably be made early next week, the court said.

Earlier this month the Croatian Supreme Court granted the state prosecutor's appeal and annulled the Split County Court's first instance verdict in the Lora case which acquitted eight former military police officers of war crimes against civilians.

The Supreme Court returned the case to the court of first instance for a retrial before a different panel of judges. The Supreme Court said in its ruling, among other things, that the court of first instance failed to establish facts and hear witnesses from Serbia.

A five-member panel of judges presided by Slavko Lozina in November 2002 unanimously acquitted Tomislav Duic, Tonci Brkic, Miljenko Bajic, Josipc Bikic, Davorc Banic, Emilijo Bungur, Ante Gudic, and Andjelko Botic after a six-month trial during which some 60 witnesses were questioned. Witnesses from Serbia and Montenegro were not heard after failing to respond to repeated summonses.
