The Constitutional Court made its ruling on September 29 and released it on its web site on Thursday.
The constitutional complaint was the last legal remedy the former nurse from Zemunik Gornji in the Zadar hinterland could resort to in Croatia. On the day when the Constitutional Court refused her appeal, Banic's attorney Luka Susak sent a letter to the Hague war crimes tribunal and prosecution proposing that they take over the case.
The Zadar County Court last year found Banic guilty of war crimes against civilians. In November 1991, Banic was among members of Croatian Serb rebel units who entered the village of Skabrnja, forcing civilians out of their basements and killing four. The Zadar court sentenced her to ten years in prison, but the Supreme Court reduced the sentence to six years.
Banic is serving her sentence in Pozega.
