Referral of Ademi-Norac case to Croatia to be discussed Thursday

ZAGREB, Feb 14 (Hina) - A special trial chamber will hold a hearing on Thursday, February 17, to discuss a proposal moved by the Prosecutor's Office that the trial of Croatian Army Generals Rahim Ademi and Mirko Norac be referred to Croatia's judiciary.

The hearing will be attended by representatives of the prosecution and the defence, the Croatian government, and two experts in law who will assume the role of amici curiae.

The hearing will be held in the presence of prosecutors and defence lawyers, but the two accused generals will not be in the courtroom. The trial chamber has invited representatives of the Croatian government and professors Mirjan Dramaska and Davor Krapac as amici curiae, ICTY Spokesman Jim Landale said.

The prosecution is expected to be represented by Chief Prosecutor Carla del Ponte. On 2 September 2004, del Ponte proposed that the Ademi-Norac case be referred to Croatia as part of the ICTY exit strategy.

Norac and Ademi will be defended by attorneys Cedo Prodanovic and Zeljko Olujic, while the Croatian government will be represented by an advisor to the Justice Minister, professor Zeljko Horvatic,

Croatian Justice Minister Vesna Skare Ozbolt is confident that after the trial chamber hears all arguments it will decide to refer the case to Croatia's judiciary. The minister said Croatia's judiciary met all expert and technical conditions to hold a war crimes trial.

Ademi and Norac are charged with war crimes against humanity and violations of laws and customs of war. Crimes were committed against Serb civilians and soldiers during the Medak Pocket operation in September 1993.
