Tadic says trial of Vukovar Three should be referred to Serbia's judiciary

BELGRADE, Feb 10 (Hina) - Serbian President Boris Tadic has asked the International Criminal Tribunal for the former Yugoslavia to refer the trial of the so-called Vukovar Three to the Serbian judiciary, Belgrade-based electronic media reported on Thursday.

According to a statement issued by Tadic's office, international institutions have highly rated the professionalism and objectivity of the Special War Crimes Court in Belgrade.

"Any other solution would destabilise the entire region, Tadic said in a statement, following a request by ICTY Chief Prosecutor Carla del Ponte that the Vukovar Three case be referred to either Croatia or Serbia's judiciary.

Del Ponte on Wednesday requested that the trial of three former Yugoslav People's Army (JNA) officers, called the Vukovar Three, who are indicted for the 1991 Ovcara massacre, be referred to courts in Croatia or Serbia and Montenegro.

The commander of the JNA Guard Brigade during the 1991 attack on the eastern Croatian town of Vukovar, General Mile Mrksic, the commander of a Guard Brigade battalion, Miroslav Radic, and the brigade's security officer, Major Veselin Sljivancanin, are charged with eight counts of crime against humanity, the violation of laws and customs of war and the execution of more than 200 Croatian prisoners of war at the Ovcara farm near Vukovar on 20 November 1991. The three officers are at the ICTY detention centre in Scheveningen.

The ICTY chief prosecutor said that both country were able to take over the case.

Croatian Justice Minister Vesna Skare-Ozbolt said on Wednesday Croatia would do all that is necessary in order to take over the organisation of the trial of the three former Yugoslav army officers. Croatian Chief State Mladen Bajic said that Croatia had precedence over the trial of Mrksic, Radic and Sljivancanin, because the crimes were committed in Croatia.
