Following the judge's decision, Glavas was released and left the court about half an hour after midnight and the decision on an investigation request and Glavas's custody was not made.
The investigating judge also dismissed the proposal of the County State Prosecutor's Office that the suspect be detained until the decision concerning the issue of local jurisdiction is made, County Court Vice President Miroslav Rozac told reporters.
The decision on the local jurisdiction will be adopted by a body of the Osijek County Court.
According to Rozac, the Office of the Prosecutor said it would appeal.

The Croatian Parliament's Credentials and Privileges Commission stripped independent deputy Branimir Glavas of his parliamentary immunity on Monday following a request by the Chief Public Prosecutor's Office (DORH).
The parliamentary commission decided that an investigation into the case could be launched and that Glavas may be placed in custody for fear of tampering with witnesses and considering the gravity of the crimes he is suspected of.
Glavas is charged with personally ordering the ill-treatment and murder of Serb civilians Cedomir Vuckovic and Djordje Petkovic and the torture of three other Serb civilians.
