Australian court supports Captain Dragan's extradition to Croatia

SYDNEY, Oct 13 (Hina) - A former commander of Serb paramilitary forces in Croatia, Dragan Vasiljkovic, will face an extradition hearing in Australia later this year after a federal court postponed his appeal on Friday, the Associated Press reported on Friday.

The 51-year-old Australian citizen, also known as "Captain Dragan", has been held in a Sydney jail since January 20 pending extradition to Croatia on the charges, which carry a maximum 20-year prison sentence.

In June, Australia's highest court dismissed an appeal by Vasiljkovic claiming that his arrest and extradition were illegal on the grounds that Australia's federal extradition laws did not specifically include Croatia, and the two countries do not have a bilateral extradition agreement, the AP said.

Last month, Vasiljkovic's lawyers filed a separate challenge before Australia's Federal Court, arguing that people accused of war crimes can't be removed from Australia under its current extradition laws, and that the matter should be treated under the Geneva Conventions, the AP wrote.

Croatian authorities have accused Dragan Vasiljkovic of ordering the torture, killing or expulsion of Croatian prisoners of war and civilians while commanding a rebel Serb paramilitary unit during the 1991 Serbo-Croat war.
