ICTY will not investigate alleged war crimes by Bosnian army troops - spokesman

MOSTAR, Aug 25 (Hina) - The Office of the Prosecutor of the International Criminal Tribunal for the former Yugoslavia (ICTY) has ruled out the possibility of the Hague-based tribunal launching an investigation into war crimes allegedly committed by the Bosnian Army Fifth Corps in western Bosnia in 1995.
MOSTAR, Aug 25 (Hina) - The Office of the Prosecutor of the International Criminal Tribunal for the former Yugoslavia (ICTY) has ruled out the possibility of the Hague-based tribunal launching an investigation into war crimes allegedly committed by the Bosnian Army Fifth Corps in western Bosnia in 1995.

The investigative mandate of the Hague tribunal has expired and we cannot initiate new investigations or issue indictments. That is a part of the tribunal's completion strategy which was adopted by the UN Security Council, spokesman for the ICTY Office of the Prosecutor Anton Nikiforov told Bosnian Federation news agency FENA in an interview on Friday.

The spokesman was commenting on recently discovered video footage which media in Serbia, Croatia and Bosnia-Herzegovina had said was proof that members of the Bosnian Army Fifth Corps committed war crimes. Some media accused the Fifth Corps commander, General Atif Dudakovic, of personally ordering the murder of prisoners of war and the burning of houses.

Nikiforov said that cases like this fell within the jurisdiction of domestic courts and that the ICTY Office of the Prosecutor could provide legal assistance.
