ZAGREB/OSIJEK, May 11 (Hina) - The Croatian Supreme Court has turned down appeals by defence teams for Branimir Glavas and other six indictees in the war crimes case dubbed the Sellotape case against their placement in custody.

The ruling of the Supreme Court, announced on the court's website on Friday, means that the decision of the Osijek County Court on placing Glavas in custody and extending custody for the other six indictees is final.

Earlier on Friday, lawyers for Glavas said they had informed in writing Croatia's human rights ombudsman, Jurica Malcic, the Croatian Helsinki Committee, and some other international organisations about last night's transfer of their client from the Osijek prison to the Zagreb prison infirmary.

They said the decision of the prison authorities was an unlawful act that violated the human rights of Glavas, who opposed his transfer to the hospital.

The condition of Glavas, who has been on a hunger strike for two weeks, has deteriorated, which was why he was taken to the prison hospital in Zagreb.

The penitentiary management department of the Justice Ministry sent a statement to Hina saying that regarding treatment of detainees on long hunger strikes, the 1975 Tokyo declaration and the Malta Declaration on Hunger Strikers, as well as the national law on serving prison terms, should be applied.

Under the national law, if a detainee's health deteriorates and doctors suggest transfer to hospital, the detainee shall be transferred to another penitentiary or prison that has conditions for medical treatment or to a prison infirmary, reads the statement.

Hunger strikers are transferred to hospital when they lose 20 percent of their weight and they can be taken to hospital sooner if their conditions deteriorates, the statement said.
