Milinovic would not comment on the suit.
In a statement over which he was sued, he wrote that the Baxter case was still waiting for an answer and that Ostojic, when he was deputy health minister, was responsible for the deaths of 24 patients after closing the ministry's incident response departmenr.
Responding to Milinovic's January statement, the Health Ministry said he was misinforming the public by defaming Ostojic and announced that Ostojic would sue him.
Ostojic did so recently and Milinovic will be among the first to account for defamation under the new penal code, which envisages a maximum punishment of 500 daily wages.
Since Milinovic is an MP, his prosecution has to be approved by parliament, which has so far refused to strip an MP of immunity from prosecution in civil lawsuits.
