ICTY GRANTS PROVISIONAL RELEASE TO TWO CROATIAN GENERALS

ZAGREB, Dec 2 (Hina) - The Appeals Chamber of the International Criminal Tribunal for the former Yugoslavia (ICTY) granted provisional release to Croatian generals Ivan Cermak and Mladen Markac on Thursday, the tribunal said in a statement.

The two generals have been in the tribunal's custody since their voluntary surrender on March 11 this year. Their lawyers expect them to return to Croatia on Friday.

The indictment against Cermak and Markac was confirmed on February 24 and unsealed on March 8 this year. They turned themselves in on March 11 and were transferred to The Hague on the same day. At their initial appearance before the court, they pleaded not guilty to all charges.

The Trial Chamber rejected two requests for provisional release filed by the generals on April 29 and September 14.

With special permission, defence counsel for the two accused filed an interlocutory appeal with the Appeals Chamber on October 22 and 26, and their request was supported by the prosecution.

Cermak and Markac are charged with six counts of crimes against humanity and violations of the laws and customs of war committed against rebel Serbs during and after the Croatian military and police operation codenamed Storm, from August to November 1995.

They are accused on the basis of individual and command responsibility for persecutions on political, religious or racial grounds, deportation and forcible resettlement, plunder of public and private property, wanton destruction of towns, settlements and villages, and murder.

The two are also charged with involvement in a joint criminal enterprise the common purpose of which was the forcible and permanent removal of the Serb population from the Krajina region.
