Although the Supreme Court quashed the ruling about the prolongation of the detention of the six indictees in the case and about taking Glavas into custody, all the detainees will remain in custody until a new decision of the County Court's panel of judges, Tripalo told Hina.
While considering an appeal of the defence on the extension and the introduction of detention, the Supreme Court overruled the decision of the County Court.
Lawyers for Glavas said that they had appealed against keeping his client in custody as they held that the decision on the detention was groundless and against the law.
They also believe that the detention of Glavas, member of parliament, also required the new assent of the parliament to the court's decision regarding custody.
The decision of the Supreme Court is likely to be delivered to Osijek on Friday evening.
Apart from Glavas, the other indictees are Gordana Getos Magdic, Ivica Krnjak, Mirko Sivic, Dino Kontic, Tihomir Valentic and Zdravko Dragic.
The prosecution charges them with the killing of Serb civilians on the Drava River banks in the eastern city of Osijek in late 1991 when eastern Croatia was exposed to attacks of the then Yugoslav People's Army (JNA) and Serb paramilitary units and local Serb rebels. One of civilians who were taken to the Drava banks survived.
