Jarnjak says will testify for Markac's defence

ZAGREB, March 25 (Hina) - The Secretary General of the Croatian Democratic Union (HDZ) and former Interior Minister, Ivan jarnjak, said on Sunday he would testify for the defence of General Mladen Markac at his trial before the UN war crimes tribunal in The Hague.
ZAGREB, March 25 (Hina) - The Secretary General of the Croatian Democratic Union (HDZ) and former Interior Minister, Ivan jarnjak, said on Sunday he would testify for the defence of General Mladen Markac at his trial before the UN war crimes tribunal in The Hague.

Jarnjak said this at a political talk show on Croatian Television answering to questions concerning disagreements between defence teams of indicted Croatian generals.

Jarnjak called on defence attorneys to cooperate so as to be able to refute the thesis on a joint criminal enterprise.

Attorney for General Markac Miroslav Separovic has been found to be in conflict of interest as defence counsel and by failing to withdraw from the proceedings at the Hague tribunal he has jeopardised his client's interest and failed to meet the standards of professional ethics, the ICTY trial chamber in charge of the Markac case concluded in February

In its decision on the issue of conflict of interest, the trial chamber ruled that Separovic "has a personal interest in the case which disqualifies him as counsel". The trial chamber believes that Separovic is likely to be called as a witness because of his personal knowledge from the time relevant to the indictment in the case "Gotovina, Cermak and Markac".

The issue of possible conflict of interest with regard to Separovic representation cropped up last year when the defence team of General Ante Gotovina, opposing the tribunal's decision to join his case with that of Cermak and Markac, cited possible conflict of interest on the part of Separovic because it mentioned the possibility of calling Separovic as a witness considering the fact that he was justice minister at the time relevant to the indictment against Gen. Gotovina.
