ZAGREB, April 30 (Hina) - At Tuesday's session, the Croatian government reached a decision to dissolve the Zagreb City Assembly and appoint Stjepan Broelich as the government commissioner for Zagreb. The decision took effect the same
day.

government reached a decision to dissolve the Zagreb City Assembly
and appoint Stjepan Broelich as the government commissioner for
Zagreb.

The government Public Relations Office on Tuesday issued a
statement which said that the government had made the decision on
the basis of the Act on Local Self-government and Administration,
under which the government had the power to dissolve Zagreb's
representative body "when it persistently made by-laws in
opposition to the Constitution, law any other regulations or due to
persistent heavy violations of the law or other regulations" and
"when it does not submit the annual budget report within the time
limit stipulated by this Act".
Supported by a Resolution of the Croatian Constitutional
Court, the government described as unlawful the calling of the
first constituent session of the Zagreb City Assembly on December
2, 1995.
With insight into the legality of work and enactments of the
Zagreb City Assembly, the Finance Ministry and the Administration
Ministry established that certain by-laws had been made illegally.
After the decision of the Constitutional Court of April 29,
1996, which had annulled Zagreb's Budget for the year 1996, it was
resolute that the Zagreb City Assembly had not submitted Zagreb's
annual budget, the statement said, adding that, taking into
consideration the above mentioned, the government had decided that
there was sufficient reason for the dissolution of the Zagreb City
Assembly.
Under the Act on Local Self-government and Administration, the
government appointed Stjepan Broelich to the post of commissioner
in Zagreb, in the place of the City Assembly.
Discussing certain issues as regarded the functioning of the
city of Zagreb and the Zagreb County, the Croatian government found
it necessary to conduct an advisory referendum for the citizens of
the region before scheduling elections, the statement said.
