Recalling the fact that the Dayton agreement provided for the
organization of the city into six municipalities, out of which
three would have the Croat and the other three the Muslim majority,
the Senate said that the Dayton agreement had been violated with EU
Administrator of Mostar Hans Koschnik's decision of 7 February to
introduce a 'central district'.
The introduction of the 'central district' restricted human
rights and civil freedoms, guaranteed by the Copenhagen Conference
on Human Rights of 1990, the Constitution of the Federation of
Bosnia-Herzegovina and the Dayton peace agreement, the appeal said.
The only way to avoid undemocratic methods in solving the
problem of the organization of Mostar was to secure a just
implementation of the Dayton peace agreement, the appeal said.
