ZAGREB, Dec 10 (Hina) - The Croatian Constitutional Court on Friday, at their first session in the new composition, dismissed a proposal of Croatia's World Congress reading that an evaluation process of the constitutional status of
the regulation of a law on the election of representatives to the Croatian National Sabor be conducted, according to which, representatives in a special (11th) electoral unit were to be elected in line with the model of a non-fixed quota.
ZAGREB, Dec 10 (Hina) - The Croatian Constitutional Court on
Friday, at their first session in the new composition, dismissed a
proposal of Croatia's World Congress reading that an evaluation
process of the constitutional status of the regulation of a law on
the election of representatives to the Croatian National Sabor be
conducted, according to which, representatives in a special (11th)
electoral unit were to be elected in line with the model of a non-
fixed quota.#L#
Croatia's World Congress believes that the regulation puts voters
with no permanent residence in Croatia in an unequal position in
relation to voters in the rest ten units, who will elect 14
representatives in each electoral unit.
The Constitutional Court believes that, according to
constitutional regulations, the general and equal right to vote
means that equal, namely approximately the same number of voters
vote for the same number of representatives. The regulation of the
disputed law in the realisation of that constitutional rule
regulates proportions between voters and representatives in the
special electoral unit to approximately the same relations valid in
other electoral units, therefore it is not correct that those
voters are in unequal position.
Therefore, this is not about the limitation of the right of voters
guaranteed by the Constitution, but about the comparison of that
right with relations which are valid for voters voting in the
Republic of Croatia, read a statement issued by the Croatian
Constitutional Court.
