ZAGREB, June 27 (Hina) - Supreme Court President Ivica Crnic on
Monday motioned to the government to urgently assess whether a
disciplinary procedure should be launched against State Prosecutor
Radovan Ortynski and his statement on the corruption of Croatia's
judiciary, assessing the statement as unallowable.
The Croatian parliament appointed Ortynski as State Prosecutor on
the government's motion in line with recent amendments to the
Constitution. After passing a law on the State Prosecution, which
came into force mid this month, conditions were created for the
state prosecutor to take oath before the parliament speaker. The
oath taking was scheduled for today, but cancelled this morning
without explanation.
The Office of the parliament speaker issued a statement under which
speaker Zlatko Tomcic would later today explain why the oath-taking
had been postponed.
In the meantime, Ivica Crnic issued a statement commenting on
yesterday's statement made by Ortynski under which a Supreme Court
decision on the release two detainees is illegal, adding this was
"the evidence that judiciary is corrupted".
Crnic believes such a statement was unallowable because "it harshly
accuses the judicial authorities in entirety without any arguments
and represents an unallowable way of communication with the
court."
By giving such a statement, Crnic said, Ortynski caused damage to
the State Prosecution's reputation. Crnic reminded the government
it is authorised to launched a disciplinary procedure against the
State Prosecutor.
The Supreme Court shall not argue in the media about unfounded
attacks and accusations, the court believes that officials
competent for the supervision of the State Prosecutor's work should
voice their opinion on the issue, Crnic said in a letter forwarded
to Prime Minister Ivica Racan.
In line with the law on State Prosecution Office, a motion for
sacking the State Prosecutor can be submitted by the government,
which has to give reasons for the sacking, and the decision is to be
passed by the parliament, which is to consider the opinion of the
Justice Committee.
