ZAGREB, May 26 (Hina) - The Constitutional Court has so far turned
down all the appeals in connection with the determination of the
number of seats which a party or coalition may get after the
percentage of the votes in their favour is rounded to a lower whole
number (integer).
An appeal of the Croatian Democratic Union (HDZ) against the
calculation of number of seats in municipalities of Seget and Brela
(Split-Dalmatia County) has been refused on this ground. This party
claimed that it should have got one more seat in municipal councils
of Brela and Seget each, but the results were rounded to the lower
integers instead to higher whole numbers.
The Croatian Party of Rights (HSP) has lodged a similar appeal with
the Court for the case of Zagvozd (Split-Dalmatia County), but it
has also been turned down.
The Court explained its ruling with precedents in the past when the
percentage was rounded to lower integers. The Court added that the
election law did not define this calculation in unequivocal terms,
however.
