The amendment was drafted following the European Commission's opinion that it might be contentious that no control mechanism was ensured in the event of the dismissal of cases initiated by USKOK when there were no injured parties.
The draft now stipulates that a panel of prosecutors in USKOK, with the USKOK head and his deputies being at the helm of that panel, can decide on the rejected cases at the first instance, and the supervision department of the Office of the Chief State Prosecutor (DORH) will deal with such cases at the next instance.
Justice Minister Drazen Bosnjakovic told the parliamentary committee that the introduction of such control mechanisms was a sub-benchmark for closing the "Judiciary and Fundamental Rights" policy area as part of Croatia's European Union accession negotiations.
