Serbia and Montenegro minister to attend meeting on Brijuni

BELGRADE, June 7 (Hina) - Serbia and Montenegro Human and Minority Rights Minister Rasim Ljajic will after all attend a trilateral ministerial meeting on the northern Adriatic archipelago of Brijuni on Wednesday, Ljajic's assistant Jelena Markovic told Hina on Tuesday afternoon, adding that Ljajic changed his decision after an agreement was reached that a proposed declaration would not be signed at the event.

Earlier on Tuesday, Ljajic said he would not attend the meeting because the draft declaration on regional cooperation was, as he said, contrary to the Serbian Constitution.

The meeting is supposed to be attended by justice ministers from Croatia, Bosnia-Herzegovina, and Serbia and Montenegro.

Ljajic told a news conference that the text of the draft declaration, under which Serbia and Montenegro would be obliged to extradite its citizens to other countries in the region, was unacceptable and contrary to the Serbian Constitution, and added that he was not authorised to sign it.

"By signing the declaration we would be obliged to extradite our citizens to other countries, which is contrary to our Constitution. We will send a delegation of experts and show readiness to participate in this process, but I cannot violate the country's Constitution," Ljajic said and added that Croatia was also opposed to signing the declaration because Croatia's Constitution also forbids the extradition of Croatian citizens to other countries.

It is unacceptable that the Organisation for Security and Cooperation in Europe (OSCE) has drafted such a document for the three countries to sign, instead of inviting task forces of the three countries to draw up the text themselves so as to have one document acceptable to all parties, Ljajic said.

Serbia and Montenegro is absolutely dedicated to cooperation between the three countries in processing war crimes and a proof of this is the fact that the Croatian State Prosecutor's Office and the State Prosecutor's Office and the Special War Crimes Prosecutor's Office in Belgrade have recently signed an agreement on cooperation during pre-trial proceedings, Ljajic said and added that Serbia and Montenegro was expected to sign the same agreement with Bosnia-Herzegovina.

The Serbian Government told Beta news agency on Tuesday that Serbian Justice Minister Zoran Stojkovic would not attend the ministerial meeting on Brijuni.

Under the draft declaration. all countries signatories to the document - namely Croatia, Serbia and Montenegro, and Bosnia-Herzegovina - would be obliged to consider the possibility to allow transfers of its citizens indicted of war crimes by another country signatory to the declaration, if legally possible.

The regulation, under which Croatia, Serbia and Montenegro and Bosnia-Herzegovina would extradite its citizens charged with war crimes to one another, is not acceptable for Croatia because it violates the Constitution, a senior official in the Croatian Justice Ministry said.

"Croatia has filed a complaint saying that the matter is regulated by the Constitution and that it is unacceptable for Croatia to sign the declaration committing it to find legal possibilities for the extradition of its own citizens," said the state secretary in the Croatian Justice Ministry, Snjezana Bagic, said last night.

Spokeswoman for the OSCE Mission in Croatia Antonella Cerasino confirmed on Monday evening there were objections to the draft declaration which was why text would be adjusted until Wednesday morning.

The OSCE only coordinates and facilitates this process, but it depends on the three countries whether or not an agreement will be reached, the spokeswoman said. There were some difficulties in the process of adjusting the draft after the first objections were made, Cerasino added. The ministerial meeting is aimed at finding a solution, she added.
