Prosecutors appeal decision upholding request for in-absentia trial in Lora case

SPLIT, Feb 24 (Hina) - The Split County Prosecutor's Office on Thursdayfiled an appeal with the Supreme Court against a decision by a panelof Split County Court judges upholding a request that four of theeight former military police officers accused of committing war crimesagainst Serb civilians in the Lora naval complex be tried inabsentia.
SPLIT, Feb 24 (Hina) - The Split County Prosecutor's Office on Thursday filed an appeal with the Supreme Court against a decision by a panel of Split County Court judges upholding a request that four of the eight former military police officers accused of committing war crimes against Serb civilians in the Lora naval complex be tried in absentia.

Deputy County Prosecutor Michele Squiccimaro said that the decision supporting the request for holding a trial in absentia was unfounded because it would be impossible to establish facts without the presence of all the accused at the main hearing.

Squiccimaro added that such a trial would be ineffective because in case any of the four accused appeared at the trial at a later date the hearing would have to be discontinued and the proceedings would have to start from the beginning.

The Split County Court upheld the request by two accused last week.

Former military policemen Ante Gudic, Davor Banic, Tonci Vrkic and Andjelko Botic are in custody, while Tomislav Duic, Miljenko Bajic, Josip Bikic and Emilijo Bungur are on the run.
