ZAGREB/THE HAGUE, Feb 23 (Hina) - A former Bosnian Army chief-of-staff, General Rasim Delic, has been indicted by the UN war crimes tribunal in The Hague for murder, cruel treatment and rape as a violation of the laws and customs of war committed against Croat and Serb prisoners by members of a Mujahedeen unit of the Bosnian Army during the war in Bosnia.

The indictment that was unsealed on Wednesday charges Delic on the basis of command responsibility for failing to punish the perpetrators from the Bosnian Army 3rd Corps' "El Moudzahid" unit.

Muslim warriors from foreign countries who called themselves the Mujahedeen or holy warriors started arriving in Bosnia in mid-1992 from Islamic countries to fight on the side of the Bosnian Muslims.

Delic is charged with the murder or disappearance of some 90 prisoners, of which 24 were Croats, with the torture of prisoners and the rape of three female prisoners. The indictment covers the period from June 8, 1993 to July 21, 1995.

The first crime with which Delic is charged is the murder of 24 and the grave wounding of at least six Croats from the village of Maline near the central Bosnian town of Travnik on June 8, 1993, on the day he took over the command of the Bosnian Army.

Although he was informed of the Maline massacre, Delic failed to punish the perpetrators.

He is also charged with crimes the Mujahedeen committed against Bosnian Serb soldiers who were taken prisoner in July 1995 in an attack on the village of Krcevine near Zavidovici, and in September 1995 in the village of Vozuca on Mt. Ozren.

The third count of the indictment charges Delic with the two-month torture and rape of three Serb women who were captured in Vozuca and taken to a prison camp in Kamenica.

The indictment also reads that Delic knew that members of the "El Moudzahid" unit were inclined to commit crimes but did nothing to prevent those crimes.

Delic received his indictment in Sarajevo on Tuesday, stating that he would surrender voluntarily to the Hague tribunal next Monday.
