Del Ponte urges UN to ensure referral of more cases to national judiciaries

WASHINGTON, Dec 15 (Hina) - The chief prosecutor of the International Criminal Tribunal for the former Yugoslavia (ICTY), Carla del Ponte, on Friday urged the UN Security Council to consider changing conditions for the referral of ICTY cases to national judiciaries and warned that otherwise it would not be possible to complete the remaining trials by the end of 2008, as envisaged by the tribunal's exit strategy.
WASHINGTON, Dec 15 (Hina) - The chief prosecutor of the International Criminal Tribunal for the former Yugoslavia (ICTY), Carla del Ponte, on Friday urged the UN Security Council to consider changing conditions for the referral of ICTY cases to national judiciaries and warned that otherwise it would not be possible to complete the remaining trials by the end of 2008, as envisaged by the tribunal's exit strategy.

Del Ponte made the statement submitting her regular six-month report to the UN Security Council.

If the Security Council does not make it possible to transfer more indictees, the tribunal will not be able to complete all trials in 2008, she said.

She also urged the Security Council to send a strong message to Serbia and

Bosnia-Herzegovina to finally extradite the six remaining fugitives and see that the ICTY's term remained in force until Ratko Mladic and Radovan Karadzic were brought to justice.

Speaking about cooperation in the region, del Ponte said that the judicial authorities of Bosnia-Herzegovina, Croatia and Serbia had intensified efforts regarding war crimes trials, but that political bodies in Bosnia-Herzegovina and Serbia were still failing to demonstrate the political will to arrest the remaining fugitives.

Del Ponte also criticised NATO, saying that despite its clear failure to arrest Karadzic and Mladic, NATO had supported the ICTY for years, which she added was not the case at the recent summit in Riga.

NATO's recent decision to admit Serbia and Bosnia-Herzegovina to Partnership for Peace is a strong sign that international support for the ICTY is on decline, del Ponte said.
